940 - Employee Benefits
This course offers an in-depth study of employee benefit claims, with a particular focus on federal claims under the Employee Retirement Income Security Act of 1974 (ERISA). Students will examine both the procedural dimensions of ERISA litigation, including preemption, exhaustion requirements, standards of review, and limits on discovery and damages, as well as substantive claims, including claims for wrongfully denied benefits and breach of fiduciary breach duty. The course will highlight the unique challenges of litigating in this specialized area and prepare students to navigate ERISA’s complex statutory and regulatory framework.
